Fatal Fire Investigation
A fire death adds agencies, authority, and legal exposure to a scene you still have to work. The origin and cause determination proceeds under the same standard of care it always does. Jurisdiction over the body sits with another office from the moment the fatality is confirmed.
Coordination with the medical examiner and law enforcement
The body falls under the authority of the medical examiner or coroner in nearly every jurisdiction. Learn your local rule before your first fatal scene. Notification should go out early, and the scene should hold until that office releases the body or authorizes movement.

Preserving the scene and the body position
Debris above and around the body carries information about fire development, ventilation, and the position in which the body was found. Overhaul and body removal can both destroy it. Once the fire is controlled, request that the incident commander limit overhaul in the immediate area, and hold the position until it is documented. The victim's last living position is a hypothesis to be tested. Suppression streams, structural collapse, and rescue attempts all move bodies.
Material under the body is often the most protected material in the room. Excavate that area deliberately after removal, under the same layer discipline used across the rest of the scene.
- Leave the body in place until the medical examiner authorizes movement
- Protect the area beneath and immediately around the body from further disturbance
- Hand and head protection is applied at the medical examiner's direction
- Note items within reach of the body and their condition before anything shifts
- Document the floor covering, mattress, or furnishing supporting the body
- Record the position of doors, windows, and furnishings around the body before entry traffic alters them
- Photograph and diagram the protected area revealed after removal
Documentation expectations at a fatal scene
Field documentation at a fatal fire should be complete enough that another qualified investigator can reconstruct the scene from it alone. Record observation and opinion separately in your notes.
- Overall, mid-range, and close photographs of the body and surroundings before movement
- Measurements from the body to at least two fixed structural points
- Body orientation relative to the area of origin and to each available exit
- Continuous video walkthrough of the structure before excavation, recommended where agency practice supports it
- A scene diagram showing body position, fire patterns, exits, and furnishings
- A log of every person who entered the scene, with times and purpose
- Chain of custody initiated at the moment of collection for every item
- Documentation of the authority for each entry and re-entry

The excavation is completed in full. Layer removal, reconstruction, pattern analysis, and hypothesis testing proceed under the methodology in NFPA 921 exactly as they would at a scene with no fatality.
The presence of a body introduces a specific interpretive risk. Fluids and tissue can sustain burning at floor level where a fabric wick is present. The resulting floor damage can resemble an ignitable liquid pattern. Collect comparison samples from unaffected areas of the same material. A positive laboratory identification supports the presence of an ignitable liquid residue. A negative result leaves the question open.
Expectation bias rises at fatal scenes. Multiple agencies, media attention, and family pressure all push toward an early answer. Test every hypothesis against the physical evidence and the fire dynamics before it goes in the report.
Victim location relative to origin and egress
Where the victim was found supports questions about awareness, mobility, and tenability. Treat each as a hypothesis. Test it against fire growth, smoke movement, and the postmortem findings.
- Distance and line of sight between the body and the area of origin
- The path between the body and the nearest usable exit
- Position of every interior and exterior door: open, closed, latched, locked, or blocked
- Window condition, including whether any were opened or breached from inside
- Obstructions, hoarding conditions, security bars, or altered egress
- Presence, location, power source, and condition of smoke alarms
- Whether the position suggests movement toward an exit, away from one, or no movement at all
- Indications the victim was asleep, seated, or engaged in an activity when the fire started
- Presence of a second victim, an animal, or an assistive device that affected movement
Postmortem findings the investigator should expect to be asked about
Cause of death and manner of death belong to the medical examiner. Fire dynamics inform both. Attend the autopsy when the office permits it and bring scene context with you.
Findings consistent with the victim breathing during the fire are among the first questions raised. Low soot deposition in the airway paired with low carboxyhemoglobin saturation raises the question of whether respiration continued once the fire began. That question is answered by the pathologist. Your contribution is the fire growth timeline and the conditions in the room.

- Soot in the nose, mouth, trachea, and lower airway
- Thermal injury distribution and depth, including areas protected by clothing or furnishings
- Heat-related postmortem changes, including the flexed posture produced by muscle contraction
- Heat-induced fractures, skull effects, and hematomas that can be mistaken for antemortem trauma
- Toxicology results, including ethanol, prescription medication, and illicit substances
- Pre-existing medical conditions bearing on mobility, awareness, or ability to self-rescue
- Method of identification: dental comparison, radiographs, DNA, or personal effects
- Any injury independent of the fire
Handling the file with prosecution or litigation expected
Assume the file goes to discovery. Assume opposing counsel retains an expert who reads every note, photograph, and lab report. Build the file to that standard from the first hour.
Entry authority is challenged in most fire-related prosecutions. Michigan v. Tyler and Michigan v. Clifford are United States Supreme Court decisions governing warrantless entry at fire scenes and the point at which an origin and cause examination requires a warrant. State constitutions and state courts impose additional restrictions in some jurisdictions. Investigators outside the United States work under a separate legal framework. Document when suppression ended, when the scene was released, and the legal basis for every subsequent entry.
- Retain contemporaneous field notes in original form, including corrections
- Preserve original photographic and video files unaltered, with metadata intact
- Maintain unbroken chain of custody documentation for every item collected
- Record consent, warrants, and their scope, along with the times of each entry
- Retain laboratory reports and the underlying data, including negative results
- Document alternate hypotheses that were considered and the evidence that eliminated them
- Keep interview records and note who was present for each
- Coordinate with the prosecutor or counsel before releasing findings
Keeping the determination defensible
Origin, cause, and classification are determined by the investigator who meets the qualifications in NFPA 1033, applying the methodology in NFPA 921. Report drafting tools, checklists, modeling, and consulting experts are aids to the investigator.
State your level of certainty and support it. Document the hypotheses you tested and the physical evidence that eliminated each one. NFPA 921 rejects a cause determination reached by elimination alone without affirmative evidence supporting the hypothesis.
Keep the fire cause separate from the medical examiner's cause and manner of death. Cite the findings of that office as the findings of that office.
- Classify as accidental, natural, incendiary, or undetermined based on the evidence developed
- Carry undetermined when the data supports nothing further; it is a valid and defensible finding
- Revisit the determination if laboratory results or autopsy findings change the data set
- Write the report so a qualified peer can follow your reasoning from observation to conclusion
- Be prepared to state, under oath, exactly which evidence supports each element of the determination
